NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

On or about January 13, 2024 the City of Asheville will submit a request to the Housing and Urban Development (HUD) Office of Community Planning and Development and the Office of  Public and Indian Housing (PIH) in Greensboro, NC for the release of Project Based Voucher (PBV) as authorized by section 8(o)(13) of the U.S. Housing Act of 1937, as amended, to undertake a project known as Fairhaven Summit for the purpose of providing affordable rental housing. The Fairhaven Summit will be a new construction apartment community, and shall consist of 77 units for families located at 3124 Sweeten Creek Road in Asheville, Buncombe County, North Carolina. The updated estimated total project costs are $23,259,623 with the estimated 20 HUD PHA Project Based Vouchers of 20 in the estimated amount of $34,121.00.

The City of Asheville has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) and will be made available to the public for review either electronically, on the City of Asheville, Community Development Website, or by U.S. mail. ENVIRONMENTAL CERTIFICATION 

The City of Asheville certifies to HUD that Debra Campbell, in her capacity as City Manager, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Asheville to use Program funds. 

OBJECTIONS TO RELEASE OF FUNDS 

HUD/ Greensboro Field Office will accept objections to its release of funds and the City of Asheville’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the Request for Release of Funds (RROF) (whichever is later) only if they are on one of the following bases: 

(a) the certification was not executed by the Certifying Officer of the City of Asheville; 

(b) the City of Asheville has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; 

(c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/Greensboro Field Office; or 

(d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. 

Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to U.S. Department of Housing and Urban Development – Greensboro Office of Community Planning & Development at CPD_COVID-19OEE-GRB@hud.gov. REQUEST FOR RELEASE OF FUNDS

On or about November 27 2023, the City of Asheville  will submit a request to the City of Asheville’ for the release of  HOME Investment Partnership  funds, under Title II 42 U.S.C. 12701 of the Cranston-Gonzalez National Affordable Housing Act, as amended, to undertake a project known as Lakeshore Villas, located at 99999 Heywood Road, Arden NC 28704.  HOME Funds will be used for the purpose of constructing 120 unit, multi-family development comprised of 1, 2 and 3 bedroom units. 

 

FINDING OF NO SIGNIFICANT IMPACT

The City of Asheville has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) and will be made available to the public for review either electronically, on the CD Website, or by U.S. mail. On or about May 16 2023, at least one day after the end of the comment period, the City of Asheville will submit a request to the Housing and Urban Development (HUD) Office of Community Planning in Greensboro, NC for the release of HOME Investment Partnership funds under Title II 42 U.S.C. 12701 of the Cranston-Gonzalez National Affordable Housing Act, as amended, to undertake a project known as Fairhaven Meadows for the purpose of building an 60-unit multifamily community of affordable rental housing. The project is located at 235 Asheville Highway, Brevard, NC 28712. Eligible households will have average  incomes at or below 60% of the area median income for Buncombe County. The development will be composed of apartments that are 1-, 2-, and 3-bedroom units. Estimated total project costs of $15,407,617  with $500,000 of HUD HOME funds (HOME funds are less than 3.5% of the total cost).

 

FINDING OF NO SIGNIFICANT IMPACT

The City of Asheville has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. The draft Allocation Plan sets out how the City of Asheville and the Asheville Regional Housing Consortium (ARHC) propose to use an estimated $4,699,862 in federal HOME-ARP Program funds.

The City is seeking a proposals from consultant(s) to research, evaluate, facilitate, and prepare a HOME-ARP Allocation Plan for the City of Asheville which will provide a framework for distribution of HOME-ARP funds as outlined by the U.S. Department of Housing and Urban Development (HUD).
 
 
The City of Asheville, as the Participating Jurisdiction for the four-county Asheville Regional Housing Consortium, is responsible for a one-time $4.7 million allocation of HOME Investment Partnerships Program funding from the United States Department of Housing and Urban Development (HUD).  The funding, known as “HOME-ARP,” is part of a $5 billion commitment in the American Rescue Plan Act of 2021 specifically targeted to reduce homelessness across the Consortium, which consists of Buncombe, Henderson, Madison, and Transylvania counties, as well as cities and towns within each county.

Asheville Proposed Action Plan for CDBG and HOME Funds

 

The City of Asheville has prepared a draft 2022-2023 Annual Action Plan, as well as an amendments to the FY16-17, FY19-20, FY20-21 and FY 21-22 Action Plans to allocate unspent prior year funds for timely public facility improvements.

The Annual Action Plan for FY 2022-2023 sets out to inform on how the City of Asheville’s Housing and Community Development Committee (HCD)  and the Asheville Regional Housing Consortium (ARHC) propose to use the estimated HOME Investment Partnership Program (HOME) funds in the amount of  $1,742,708 in federal funds and the Community Development Block Grant (CDBG) funds in the amount of  $1,439,856 in federal funds for the program year beginning July 1, 2022.

Asheville Proposed Action Plan for CDBG and HOME Funds

 

 

The City of Asheville has prepared a draft 2022-2023 Annual Action Plan, as well as an amendment to the FY 2021-2022 Action Plan to allocate unspent prior year CDBG funds for timely public facility improvements.

The Annual Action Plan for FY 2022-2023 sets out to inform on how the City of Asheville’s Housing and Community Development Committee (HCD)  and the Asheville Regional Housing Consortium (ARHC) propose to use the estimated HOME Investment Partnership Program (HOME) funds in the amount of  $1,627,886 in federal funds and the Community Development Block Grant (CDBG) funds in the amount of  $1,422,119 in federal funds for the program year beginning July 1, 2022.

These notices shall satisfy two separate but related procedural requirements 

for activities to be undertaken by the City of Asheville.

 

 

REQUEST FOR RELEASE OF FUNDS

On or about March 13, 2022, at least one day after the end of the comment period, the City of Asheville will submit a request to the Housing and Urban Development (HUD) Office of Community Planning in Greensboro, NC for the release of HOME Investment Partnership funds under Title II 42 U.S.C. 12701 of the Cranston-Gonzalez National Affordable Housing Act, as amended, to undertake a project known as Fairhaven Summit for the purpose of providing affordable rental housing. The Fairhaven Summit will be a new construction apartment community, , and shall consist of 77 units for families located at 3124 Sweeten Creek Road in Asheville, Buncombe County, North Carolina.  The estimated total project costs are $17,282,879 with the estimated HUD HOME funds of $400,000 comprising 2 percent of the funding. 

 

FINDING OF NO SIGNIFICANT IMPACT

The City of Asheville has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) and will be made available to the public for review either electronically, on the CD Website, or by U.S. mail. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Asheville to use Program funds.

 

OBJECTIONS TO RELEASE OF FUNDS

HUD/Greensboro Field Office will accept objections to its release of funds and the City of Asheville’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the Request for Release of Funds (RROF) (whichever is later) only if they are on one of the following bases: 

(a) the certification was not executed by the Certifying Officer of the City of Asheville; 

(b) the City of Asheville has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; 

(c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/Greensboro Field Office; or 

(d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. 

 

Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to U.S. Department of Housing and Urban Development – Greensboro Office of Community Planning & Development at CPD_COVID-19OEE-GRB@hud.gov. PUBLIC NOTICE For the Programmatic Agreement Between The City of Asheville and 

The North Carolina State Historic Preservation Officer

December 22, 2021

 

 

This notice is to inform the public and citizens of Asheville North Carolina that the City of Asheville (City) is  requesting to enter into a Programmatic Agreement (PA) with the North Carolina State Historic Preservation Officer (SHPO).  

The attached proposed Programmatic Agreement (PA) is a contract between the City of Asheville (City) and the North Carolina State Historic Preservation Officer (SHPO) stipulating specific measures that must  be implemented in order to adequately avoid or satisfactorily mitigate any adverse effect on historic  properties per 36 CFR 800 Protection of Historic Properties are the ACHP’s regulations for implementing a Section 106 process that will apply to all undertakings under these particular programs.

These specific measures are outlined in the agreement as the following: Qualifications of City  Staff, Identification of Historic Properties, Exempt Activities, Rehabilitation and New Construction,  Adverse Effects, Archeology, Project Documentation and Record-keeping, Dispute Resolution,  Agreement Modification and Termination. Further, the PA demonstrates the City’s intent to comply with  the historic review portion of the HUD-mandated environmental review process. The goal of the PA is to reduce the burden of requests sent to the State as well as the response time, while still implementing  Section 106 of the National Historic Preservation Act, as amended (16 U.S.C. 470F).  This process also saves time by permitting reviews at the local level, especially in the case of emergency repair projects; it builds staff capacity/expertise/cooperation across housing and preservation areas and better integrates historic preservation into local planning with the on-going identification and evaluation of historic resources. 

Historically, the City has had programmatic agreements with the SHPO. At the expiration of the last PA,  the SHPO was unable to extend the agreement and the City returned to directly contacting the SHPO and Tribal Historic Preservation Officer (THPO). The implementation of a new PA is warranted as the City is completing more construction projects and the SHPO is able to enter into new agreements.  

The City, in accordance with the provisions of the Housing and Community Development Act of 1974, as  amended (CDBG), the HOME Investment Partnership Program Act (HOME), HOME Investment Partnerships-American Rescue Plan (HOME-ARP), and Continuum of Care (COC) Programs will administer projects and act  as the Responsible Entity for acquisition, rehabilitation, demolition, new construction and infrastructure  improvements throughout its jurisdiction for the 2021 – 2026 fiscal years. The City has determined that the execution  of the individual activities of these programs may have an effect upon properties and districts that are  listed in or may be eligible for listing in the National Register of Historic Places (National Register) as  defined in 36 CFR Part 800, the regulation of the Advisory Council on Historic Preservation for  implementing Section 106 of the National Historic Preservation Act, as amended (16 U.S.C. 470f).  

Certain activities under the programs noted above may depart from the normal Section 106 process  only if and when those programs involving historic properties have limited potential to affect historic  properties and are approved by the Historic Preservation Professional (HPP) staff. These activities are outlined in the PA under Section  III titled “Exempt Activities”. It is unknown at this time if there are any similarities or repetitive effects  to historic properties; additionally only limited effects such as deterioration, physical destruction and  neglect can be fully determined prior to the approval of an undertaking. 

 

Under the PA, the City’s HPP will conduct historic reviews  and determine if the SHPO or THPO will need to be consulted. The  Historic Resources Commission of Asheville & Buncombe County/HPP and the Asheville Buncombe Historic Preservation Society will be concurring parties, should they accept the invitation. The City has also sent correspondence to the Muscogee (Creek) Indian Nation THPO, Cherokee Indian Nation THPO, Catawba Indian Nation THPO, Eastern Band of Cherokee Indians THPO, and the United Keetoowah Band of Cherokee Indians in Oklahoma THPO with the proposed PA and has asked for concurrence, should they  accept. In the absence of the previous PA, the City has continued to contact the Tribe THPO’s on all projects involving  ground disturbance.

The HUD HOME funds allocated for this project is $180,000 for Phase 5 and $106,203 for Phase 6 for the purpose of providing affordable homeownership. The estimated total project costs are $6,500,000 with the estimated total HUD HOME funds of $286,203 out of $801,841 to date comprising around 12 percent of the funding. This project is also allocated HUD SHOP funds of $225,000, with a total of $1,131,050 SHOP funds to date.

The City of Asheville has prepared draft Amendments to the FY 2020-2021 and FY 2021-2022 Housing and Community Development Annual Action Plans for public comment: The Annual Action Plan for FY 2021-2022 sets out to inform on how the City of Asheville and the Asheville Regional Housing Consortium proposes to use the estimated $1,053,291 in federal Community Development Block Grant (CDBG) funds and $1,296,760 in federal HOME Investment Partnership Program funds for the program year beginning July 1 2021. The amendment to the 2020-2024 Consolidated Plan reflects a reduction to the 2020-2021 Annual Action Plan HOME program income budget and adjustments to projects awarded those funds.

The Consolidated Plan is a five year plan that is designed to help states and local jurisdictions to assess their affordable housing and community development needs and market conditions, and to make data-driven, place-based investment decisions.  This Plan sets out regional priorities for the next five years and is carried out through the Annual Action Plan, which provides a concise summary of the actions, activities, and the specific federal and non-federal resources that will be used each year to address the priority needs and specific goals identified by the Consolidated Plan. 

 

Public Comment Period and Process: 

 

The DRAFT FY 20/21 CAPER is available for a 15-day public review and comment period  from Sunday, September 12, 2021 to Sunday, September 26, 2021.   

Citizens wishing to submit written comments during the public review and comment period may send them via email to Paul D’Angelo, Community Development Program Director, at pdangelo@ashevillenc.gov  until 5pm on Sunday, September 26, 2021.   

You may also send your comments via mail, postmarked no later than Sunday, September 26, 2021, by 5pm, to the following address:

The consolidated planning process serves as the framework for a community-wide dialogue to identify housing and community development priorities that align and focus funding from the CPD formula block grant programs: Community Development Block Grant (CDBG) Program, HOME Investment Partnerships (HOME) Program, Emergency Solutions Grants (ESG) Program, and Housing Opportunities for Persons With AIDS (HOPWA) Program.

21/22 HUD HOME Application – 2nd Round Funding Applications available for New Applicants

 

PLEASE NOTE:  NEW HUD HOME applications are only available to eligible applicants in either Henderson or Transylvania County.

Due Date for New Applicants: Thursday, September 9th, 12 noon – Please Read below.

The Asheville Regional Housing Consortium will have approximately $437,862 of HOME funds to reallocate in our 2nd Round of funding. The Consortium Board made the following recommendations for the 2nd Round eligibility criteria at their March 25, 2021, meeting.

To be “Second Round” application eligible –

  • Projects that were not funded in initial round or that were partially funded in initial round of funding.
    • TC projects not awarded from NCHFA are not eligible to ask for funding in this cycle
    • There are approximately $1,144,298 in requests that would be eligible to come back for funding
  • Any CHDO (Community Housing Development Organization) projects.
    • $40,614 still to be allocated or held as CHDO reserve
    • Reminder that the CHDO set-aside is a minimum amount and does not put a cap on CHDO allocations.
  • New projects from Consortium Member County Jurisdictions that are either not awarded any funding in this initial round or not awarded a tax credit allocation in August by NCHFA.
    • This would include Henderson & Transylvania Counties
  • Projects that were awarded their full request amount but due to changes over the last 6 months since application have a need for additional funding (i.e. rising construction costs, Covid challenges, etc.)

CONCURRENT NOTICE OF FINDING OF NO SIGNIFICANT IMPACT (FONSI)  AND 

NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS (NOI-RROF)

 June 15, 2021

 

These notices shall satisfy two separate but related procedural requirements 

for activities to be undertaken by the City of Asheville.

 

REQUEST FOR RELEASE OF FUNDS

On or about July 4, 2021, at least one day after the end of the comment period, the City of Asheville will submit a request to the Housing and Urban Development (HUD) Office of Community Planning in Greensboro, NC for the release of HOME Investment Partnership funds under Title II 42 U.S.C. 12701 of the Cranston-Gonzalez National Affordable Housing Act, as amended, to undertake a project known as The Villas at Swannanoa for the purpose of providing affordable rental housing. The Villas at Swannanoa will be a new construction apartment community for seniors (55+) located at 2255 US Highway 70, in Swannanoa (Buncombe County) and shall consist of 60 units.  The estimated total project costs are $10,306,000 with the estimated HUD HOME funds of $840,000 comprising 8 percent of the funding. 

 

FINDING OF NO SIGNIFICANT IMPACT

The City of Asheville has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) and will be made available to the public for review either electronically, on the CD Website, or by U.S. mail. PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the City of Asheville Community Development Division via mail (to the address above) or via email (to the email address above). All comments received by July 3, 2021 will be considered by the City of Asheville prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

 

ENVIRONMENTAL CERTIFICATION

The City of Asheville certifies to HUD that Debra Campbell, in her capacity as City Manager, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Asheville to use Program funds.

 

OBJECTIONS TO RELEASE OF FUNDS

HUD/Greensboro Field Office will accept objections to its release of funds and the City of Asheville’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: 

(a) the certification was not executed by the Certifying Officer of the City of Asheville; 

(b) the City of Asheville has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; 

(c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/Greensboro Field Office; or 

(d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. 

 

Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to U.S. Department of Housing and Urban Development – Greensboro Office of Community Planning & Development at CPD_COVID-19OEE-GRB@hud.gov. Potential objectors should contact the U.S. Department of Housing and Urban Development – Greensboro Office of Community Planning & Development via this email to verify the actual last day of the objection period.

$1.6M CDBG Program Income / Sale of Charlotte Street Parcels (White Labs)

The City of Asheville has prepared a draft Amendment to the 2020-21 Action Plan, a summary of which can be found here. The Amendment to the Annual Action Plan for 2020-21 sets out how the City of Asheville plans to allocate an estimated $1.6 M in Community Development Block Grant Program Income (CDBG PI) funds.

The staff report and resolution will be posted on the internet after 3 p.m. on Friday March 19, 2021 and is also available at the Community and Economic Development Department, Fifth floor of City Hall, upon request. A public hearing on the plan will be held virtually at the City Council meeting starting at 5 p.m. on Tuesday March 23, 2021, with a formal vote to follow on April 13, 2021.
